USA - Appearance-based discrimination

A survey of people in a range of industries across the US found that 85 per cent of respondents believe that tattoos and body piercings reduce the chance of getting employment.

Appearance based discrimination in the workplace has become a very serious problem. Stores like Hollister Co. and Abercrombie & Fitch are told to only hire employees that are attractive. Those that aren't attractive enough are given jobs in the back where customers cannot see them. How is this legal?
